Trusted Family Law Arbitration Services Across Ireland
A Private, Practical & Legally Sound Path to Resolution
At Family Arbitration.ie, we provide a specialised Family Law Arbitration service to people wishing not to use the ordinary Court system but who would rather use a private Judge (Arbitrator) to decide a legal dispute. Matters of family law are sensitive and it is our job to offer an alternative to the public Court system that offers confidentiality, is structured, is legal and enables the issues to be determined and concluded in a private and efficient manner.
Understanding Family Law Arbitration in Ireland
Family Arbitration.ie gives separating or divorcing people an opportunity to select a neutral and qualified Arbitrator to make legally binding and enforceable Awards (known as “Orders” in the public Court system) on issues in family law such as custody and access, spousal and child maintenance, property and asset rights, distribution and ownership and pension division. Unlike mediation, arbitration results in a formal written decision after the Arbitrator reviews evidence and submissions from both parties.
The judgement issued by an Arbitrator is known as an Arbitral Award, which in accordance with Irish and international law is legally binding not only in Ireland but also in another 187 jurisdictions around the world. This Award is enforceable in the Irish courts and has the same authority as that of a regular Court Order.
Family arbitration is particularly well-suited to individuals who:
Why Choose Family Arbitration.ie?
Accredited Family Law Expertise
We deal only with qualified and accredited Arbitrators familiar with Irish family law. Not only do they have knowledge of the legal framework but also the emotional realities that families undergo during the separation.
Decisions With Legal Certainty
Arbitral Awards made under our process are legally binding and enforceable in Ireland. This brings clarity and finality. Both parties can proceed with their lives knowing their family law issues have been determined and dealt with.
Absolute Privacy
Arbitration is not publicised. Your personal and financial issues are not public and will not be discussed in public court hearings.
A Process Built Around You
Each arbitration is designed to suit the needs of the parties. Regardless of whether you are looking to solve one issue or looking to resolve several issues collectively, the process is tailored to suit your situation.
A More Cost-Conscious Alternative
Arbitration may provide a more manageable and forecastable cost-system as compared to conventional litigation by eliminating the necessity to go to court on multiple occasions. The time from beginning to end of an arbitration hearing is nearly a third of the time as compared to public Court proceedings. This leads to an overall reduction in legal costs.
Family Law Matters Suitable for Arbitration
Our Family Law Arbitration services cover a broad range of issues, including:
Determining fair and sustainable financial support arrangements.
Establishing practical care schedules, access rights and parental responsibilities.
Decisions relating to the family home, savings, pensions, investments and other assets.
Including asset separation and determinations on family-owned businesses.
Each case is handled with care, neutrality and professionalism, ensuring both parties are heard fully before any binding decision is made.
Our Step-by-Step Family Arbitration Process
Step 1: Initial Discussion
We can be contacted directly by parties or by their Solicitors. www.familyarbitration.ie. If we are contacted by the parties directly we will discuss the process of arbitration and whether it is suitable for the case. It is strongly recommended to engage legal representation because at the end of the day a legally binding, legally enforceable and full and final determination of the case will be delivered by the Arbitrator. We have a list of Solicitors for parties who wish to engage Solicitors to advise and represent them in the arbitration process.
Both parties have to agree to use arbitration to determine the family law matter(s) so we would need both parties to confirm their agreement.
Step 2: Formal Agreement to Arbitrate
The parties sign a written Agreement to Arbitrate. This sets out the agreement to use arbitration. It also sets out the fees to use the arbitration process.
Step 3: Information Exchange
The documentation, pleadings and evidence are provided to the Arbitrator before the arbitration hearing. These can be provided to the Arbitrator by the Solicitors or if there are no Solicitors by the parties themselves.
Step 4: Hearing and Submissions
The cases are presented either through submissions to the Arbitrator and/or in front of the Arbitrator.
Step 5: Issuing of the Arbitral Award
The Arbitrator makes a final decision which is legally binding and may be enforced in the Irish courts.
